Terms & Conditions

These Terms of Service ("Terms") are an agreement between you and Orix Marketing, Sri Lanka, which operates and markets LISTLAH ("we", "us"), an online classifieds marketplace for people and businesses in Singapore. By creating an account, posting a listing or otherwise using LISTLAH, you agree to these Terms, our Privacy Policy and our Marketplace Rules. If you do not agree, please do not use LISTLAH.

1. Who can use LISTLAH

• You must be at least 18, or have the consent of a parent or guardian, and able to enter into a binding agreement. Paid services are for users aged 18 and over.
• You must give accurate details and keep them up to date.
• You are responsible for everything done through your account. Keep your password secret, and never share one-time passwords (OTPs) or Singpass codes with anyone, including anyone claiming to be from LISTLAH.
• One person should have one personal account. Businesses may open a business account. Creating accounts to get around limits, restrictions or bans is not allowed.

2. Our role

LISTLAH is a venue. We do not own, inspect, store or deliver the items listed; we do not collect, hold or pass on payments between buyers and sellers; and we are not a party to any deal between them. Any sale is a contract between the buyer and the seller.

Badges such as "Verified seller" or "Business verified" mean only that we completed the checks described on our website, for example a verified mobile number or business registration details. A badge is not a guarantee, an endorsement or a government rating.

3. Listings

• Basic listings are free within each category's monthly allowance and live-listing limit. Allowances depend on your verification level and account history and may change. Removing, selling or letting a listing expire does not restore that month's allowance.
• Your listing must describe a real item or service that you are entitled to sell, at a genuine price in Singapore dollars, in the right category and planning area, and must follow our Marketplace Rules.
• Listings expire after the period shown for their category and can be renewed a limited number of times.
• Our automated checks and moderators may stop a listing going live, send it for review, limit where it appears or remove it. We may not explain the specific reason, to protect the methods we use against fraud. Contact us if you think we made a mistake.
• You keep ownership of what you post. You give us a non-exclusive, royalty-free licence to host, display, adapt (for example resize photos) and promote your listings on LISTLAH and our marketing channels while they are live and for a reasonable time after.

4. Buying

Meet in a safe public place, inspect the item before you pay, and never pay a deposit to someone you have not met. Read our Safety tips. Sales by businesses may be covered by the Consumer Protection (Fair Trading) Act 2003 and the Sale of Goods Act 1979.

5. Paid services

• Promotions (Bump Lah, Featured and Spotlight), LISTLAH Business and credits are optional. Prices are shown in Singapore dollars on our pricing page, and there are no hidden fees.
• Payments are processed by our payment partner PayHere. Where a payment is charged in another currency (PayHere charges in Sri Lankan rupees), we show you the exact amount and exchange rate before you pay, and you must confirm it.
• A paid service starts when the payment provider confirms your payment to us. Paying for a promotion does not exempt a listing from our rules or checks.
• Promotional credits have no cash value, cannot be transferred and expire on the date shown.
• Refunds follow our Refund Policy.

6. Acceptable use

You must not:

• break the law or our Marketplace Rules, or post prohibited, counterfeit, false, misleading or duplicate listings;
• scam, defraud, threaten, harass or discriminate against other users, or ask for payment links, deposits or OTPs;
• send spam, or use other users' contact details for anything other than the listing in question;
• manipulate prices, reviews or reports;
• scrape LISTLAH or access it by automated means without our written permission;
• interfere with LISTLAH's security or operation, or impersonate another person or business.

7. Messages and reviews

Use LISTLAH chat for your deals. We scan messages automatically for scam patterns and may show safety warnings, and we may review messages that are reported or when investigating fraud. Reviews must reflect a genuine experience.

8. Our actions

We may remove content, limit, hold or suspend features or accounts, cancel promotions and report illegal activity to the authorities when we reasonably believe it is needed to protect users, LISTLAH or others, or to comply with the law. Where we can, we will tell you and give you a chance to respond. You can close your account at any time in Privacy.

9. Intellectual property

The LISTLAH name, logo, website design and software belong to us or our licensors. If you believe a listing infringes your copyright or trade mark, send us the listing link and details of your rights and we will review it promptly.

10. Liability

• LISTLAH is provided "as is". We work to keep it available and secure but do not promise it will be uninterrupted or error-free.
• To the extent the law allows, we are not responsible for the items listed, the conduct of users, deals between users or losses from another user's scam, or for indirect or consequential losses.
• To the extent the law allows, our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and S$100.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Singapore law, including under the Unfair Contract Terms Act 1977 and the Consumer Protection (Fair Trading) Act 2003.

11. Changes

We may update these Terms. We will post the new version here with a new "Last updated" date and give registered users notice of significant changes before they take effect. Continuing to use LISTLAH after that date means you accept the change.

12. Governing law and disputes

These Terms are governed by the laws of Singapore. Please contact us first so we can try to resolve any concern. If we cannot, you may refer the matter to mediation (for example at the Singapore Mediation Centre), to the Small Claims Tribunals where eligible, or to the courts of Singapore, which have jurisdiction.
